Supreme Court will hear Babri Masjid case on August 11
In a major development, the Shia Waqf Board on Tuesday filed an affidavit before the apex court in which it stated that a mosque can be constructed at a place near birth place of Lord Ram.
BJP leader and member of the Rajya Sabha, Subramanian Swamy, praised the move:In a very insightful observation, the Board reportedly said that the construction of a mosque and the temple on the same land will lead to confrontations in the future. Shia Board have chose to confront an order, made by Faizabad court in 1946, which states that the Babri Masjid belonged to the Sunni Central Waqf Board.
The Board also claimed in an affidavit that the Babri Masjid site was its property and only it was entitled to hold negotiations for an amicable settlement of the dispute. However, the Board has sought time from the SC for setting up of a committee for exploring a peaceful resolution of the conflict. According to the Shia Waqf Board, they can also leave the claim on the disputed site, if the government gives them the place to make such a mosque in another place.
While averring that the Shia's have always vouched for peace in the matter, Swamy said that Shia's affidavit is god sent which will give his case a positive push.
The submission from the Board came days ahead of the scheduled hearing in the highly vexed case in the Supreme Court from August 11.
The Board mentioned in its plea that Babri Masjid belonged to Shia Waqf.
"Only the Imam and Muezzins of the mosque were Sunni who were paid by the Shia Mutawwali".
The top court had earlier said that if required, a principal mediator can be chosen by the court for settling the Ayodhya issue.
The Board alleged that previous Shia and Sunni Waqf Boards worked in tandem and willfully lost the case.
In fact, the Lucknow bench of the Allahabad High Court had ordered the division of 2.77 acres of land to the three parties in 2010 in the decision of the Janmabhoomi dispute.
The Special Bench will include Justices Ashok Bhushan and S. Abdul Nazeer.
