Federal Court Blocks Trump's Transgender Military Ban

Federal Judge Blocks Trump's Ban On Transgender Service Members In The Armed Forces

He said he would order a return to the policy prior to June 2016, under which service members could be discharged for being transgender.

U.S. District Judge Colleen Kollar-Kotelly issued the preliminary injunction Monday, report the Washington Post, Think Progress and the Associated Press. The memo also gave Defense Secretary James MattisJames Norman MattisPence to visit ICBM base McAfee stops allowing governments to review source code Terror designation for Iran's Revolutionary Guards a necessary first step MORE six months to determine what to do with transgender troops who are now serving.

The judge - who was named to the court by President Bill Clinton - noted in her ruling that the changes in transgender policy were "not genuinely based on legitimate concerns regarding military effectiveness or budget constraints, but are instead driven by a desire to express disapproval of transgender people generally".

Mr Trump signed a memorandum in August that directed the United States military not to accept transgender men and women as recruits and halted the use of government funds for sex-reassignment surgeries for active-duty personnel unless the process is already under way.

GLBTQ Legal Advocates & Defenders, or GLAD, issued a statement about the ruling in favor of plaintiffs from their organization and the National Center for Lesbian Rights. "This decision has already been made. Plaintiffs have established that they will be injured by these directives, due both to the inherent inequality they impose, and the risk of discharge and denial of accession that they engender". "We are grateful to the court for recognizing the gravity of these issues and putting a stop to this unsafe policy, which has wreaked havoc in the lives of transgender service members and their families".

The judge, however, tossed out the suit's challenge to the sex-reassignment surgery directive, saying none of the plaintiffs had shown they would be impacted by that prohibition.

In August, Trump said he planned to reverse a 2016 policy, which allowed trans troops to serve openly in the USA military. The Court therefore ruled that active duty trans servicemembers can continue to serve but the halt to the accessions policy pertaining to recruitment and promotion that Sec. of Defense Mattis put in place will also remain in effect until the constitutionality of the Directive is determined. "The Department of Justice has it, they're reviewing it and I'd refer you to them for any specific questions".
