On December 23 of the same year, she says Weinstein showed up in the lobby of her apartment, they went upstairs and de la Huerta alleges he raped her a second time.
"We have an actual case going forward", Chief of Detectives Robert K. Boyce said.
"If this person were still in NY, and it was recent, we would go right away and make the arrest, no doubt", Boyce said.
The 65-year-old was seen in a pretty ineffective disguise at a Chestnut restaurant in Phoenix on Thursday night, where he could be seen wearing a blonde wig, orange make-up and a baseball cap.
"Mr Weinstein is out of state, we would need an arrest warrant to arrest him. Right now we're gathering our evidence and continue to do so".
He continued: "We then sought to garner corroboration".
The actress's claims are very similar to ones shared by many among the more than 60 women who have come forward accusing Weinstein of assault, harassment, or rape.
The allegations by de la Huerta follow more than 50 others made by women against Weinstein.
Weinstein, who was ousted from his own company amid the scandal, has repeatedly stated through a spokesman that "allegations of non-consensual sex are unequivocally denied".
"Immediately when we got inside the house, he started to kiss me and I kind of brushed [him] away", de la Huerta said.
"He hushed me and said, 'Let's talk about this in your apartment, '" de la Huerta said. I laid there feeling sick.
Five days before the NY police were contacted about de la Huerta, Boyce had said in a statement that they were following up in information regarding Weinstein while also referring calls they received to jurisdictions both inside and outside the United States.
"He left and I never heard from him again, he knew he had done a bad thing".
